Terms of Use

The Terms of Use (the “Agreement”) specify the terms and conditions for access to and use of AllyNetwork.org (the “Site”). The Site is composed of content and from various mental/behavioral health professionals and operated and managed by Diversity in Health Training Institute with the assistance of partners. By using the Site, you agree to comply with and be bound by the following terms and conditions of use. Please review the Agreement carefully. If you do not agree to these terms and conditions, you should not use the Site.

Modification of These Terms of Use

AllyNetwork may modify the terms, conditions, and notices under which the Site is offered, including but not limited to the charges associated with the use of the Site, at any time upon posting of the modified Agreement. Any such modifications shall be effective . You may view the most recent version of the Agreement at any time at AllyNetwork.org. Each use by you shall constitute and be deemed your unconditional acceptance of the Agreement.

No Unlawful or Prohibited Use

As a condition of your use of the Site, you warrant to AllyNetwork that you will not use the Site for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Site in any manner which could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site. Use of Communication Services

The Site may contain access to services, bulletin board services, chat areas, forums, communities, personal web pages, calendars, and/or other message or communication facilities designed to enable communication between individuals of underserved communities seeking care and mental/behavioral health professionals, you agree to use the Communication Services only to post, send and receive messages and material that are proper and related to the particular Communication Service. By way of example, and not as a limitation, you agree that when using a Communication Service, you will not:

Defame, , harass, stalk, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, infringing, obscene, indecent or unlawful topic, name, material or information.
Upload files that contain software or other material protected by intellectual property laws (or by rights of privacy of publicity) unless you own or control the rights thereto or have received all necessary consents.
Upload files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another’s computer.
Advertise or offer to sell or buy any goods or services for any business purpose, unless such Communication Service specifically allows such messages.
Conduct or forward surveys, contests, pyramid schemes or chain letters.
Download any file posted by another user of a Communication Service that you know, or reasonably should know, cannot be legally distributed in such manner.
Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Restrict or any other user from using and enjoying the Communication Services.
Violate any code of conduct or other guidelines which may be applicable for any particular Communication Service.

AllyNetwork has no obligation to monitor the Communication Services. However, AllyNetwork reserves the right to review materials posted to a Communication Service and to remove any materials in its sole . AllyNetwork reserves the right to terminate your access to any or all of the Communication Services at any time without notice for any reason whatsoever.

AllyNetwork reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in AllyNetwork’s sole .

Notwithstanding these rights, you remain solely responsible for the content of your submissions. You acknowledge and agree that neither AllyNetwork nor its suppliers will assume or have any liability for any action or inaction by AllyNetwork or its suppliers with respect to any submission.

Materials uploaded to a Communication Service may be subject to posted limitations on usage, reproduction and/or dissemination. You are responsible for adhering to such limitations if you download the materials.

AllyNetwork and/or its suppliers may make improvements and/or changes in the Site at any time. Advice received via the Site should not be relied upon for personal, medical, legal or financial decisions and you should consult an appropriate professional for specific advice tailored to your situation.

The information, software, products, services and related graphics provided for by AllyNetwork and/or its suppliers is provided on an “AS IS,” “AS AVAILABLE” basis. You agree that use of this site, including but not limited to receiving advice, is at your sole risk. AllyNetwork disclaims all warranties of any kind, including but not limited to any express warranties, statutory warranties, and any implied warranties of: merchantability, fitness for a particular purpose, and non-infringement. AllyNetwork reserves the right, and you authorize us, to use and assign all information regarding Site uses by you and all information provided by you in any manner consistent with our Privacy Policy.

Indemnification

You agree to indemnify, defend, and hold AllyNetwork and our partners, employees, affiliates, and suppliers, harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to your violation of this Agreement or use of the AllyNetwork website.
